1. Acceptance of Terms

Welcome to Guns & Fury, a mobile game developed and published by Golden Fox LLC ("we," "us," "our," or "Company"). These Terms and Conditions ("Terms") govern your access to and use of Guns & Fury (the "Game" or "Service"), including any updates, new features, and related services.

By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Game. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Game.

2. License Grant

Subject to your compliance with these Terms, Golden Fox LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Game for your personal, non-commercial entertainment purposes on a device you own or control.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Game
  • Reverse engineer, decompile, or attempt to extract the source code of the Game
  • Remove, alter, or obscure any proprietary notices on the Game
  • Use the Game for any commercial purpose or for the benefit of any third party
  • Create derivative works based on the Game
  • Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software
  • Attempt to gain unauthorized access to the Game, accounts, computer systems, or networks

3. Account Registration and Security

To access certain features of the Game, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not create an account using a false identity, impersonate another person or entity, or use a username that is offensive, vulgar, or infringes someone else's rights. We reserve the right to refuse registration or cancel accounts at our discretion.

4. Age Restrictions and Children's Privacy

The Game is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use the Game or provide any information. If we discover that a child under 13 has provided us with personal information, we will delete such information.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission before using the Game and making any purchases.

5. In-App Purchases and Virtual Currency

5.1 Purchases

The Game may offer in-app purchases of virtual items, virtual currency, subscriptions, or other digital content ("Virtual Items"). All purchases are processed through the platform from which you downloaded the Game (Apple App Store or Google Play Store). Your purchases are subject to the platform's payment terms and policies.

5.2 Virtual Items

Virtual Items have no monetary value and do not constitute personal property. Virtual Items are non-transferable and may not be sold, traded, or exchanged for real money or anything of value outside the Game. We may modify, manage, control, or eliminate Virtual Items at any time, with or without notice. We have no liability for the exercise of such rights.

5.3 No Refunds

All purchases are final. We do not provide refunds for Virtual Items or in-app purchases except as required by applicable law or the platform's refund policy. For refund requests, contact the platform (Apple or Google) from which you made the purchase.

5.4 Price Changes

We reserve the right to change prices for Virtual Items at any time without notice. Any price changes will not affect purchases made prior to the change.

6. User Conduct and Community Rules

When using the Game, especially multiplayer features, you agree to:

  • Treat other players with respect and courtesy
  • Not engage in harassment, bullying, hate speech, or abusive behavior
  • Not post, share, or transmit content that is illegal, offensive, sexually explicit, defamatory, or infringes intellectual property rights
  • Not engage in activities that disrupt or interfere with the Game or other players' experience
  • Not attempt to manipulate rankings, ratings, or game economy
  • Not engage in real-money trading or selling of accounts or Virtual Items
  • Comply with all applicable laws and regulations

7. Intellectual Property Rights

The Game and all content, features, functionality, graphics, audio, code, and materials are owned by Golden Fox LLC or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Golden Fox, Guns & Fury, and related logos are trademarks or registered trademarks of Golden Fox LLC. You may not use these trademarks without our prior written permission.

8. User-Generated Content

The Game may allow you to create, post, or share content such as usernames, profile information, or messages ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not violate any third-party rights or applicable laws.

9. Online Services and Multiplayer

The Game includes online multiplayer features that require an internet connection. We do not guarantee that online services will be available at all times or that they will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any aspect of the online services at any time.

We may perform scheduled or unscheduled maintenance, which may result in service interruptions. We are not liable for any interruption of service or loss of data resulting from maintenance or technical issues.

10. Account Suspension and Termination

10.1 Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your account and access to the Game at any time, with or without notice, for any reason, including if:

  • You violate these Terms or any applicable law
  • You engage in fraudulent or illegal activity
  • You use cheats, exploits, or unauthorized third-party software
  • You engage in conduct that harms other players or the Game
  • Your account has been inactive for an extended period
  • We discontinue the Game or any part of it

10.2 Effect of Termination

Upon termination, your right to use the Game will immediately cease. You will lose access to your account, including any Virtual Items, progress, or other data associated with your account. We are not obligated to provide refunds for any purchases or Virtual Items upon termination.

10.3 Your Right to Terminate

You may terminate these Terms at any time by uninstalling the Game and discontinuing use. You may also request deletion of your account by contacting us at privacy@goldenfox.games.

11. Third-Party Services and Links

The Game may contain links to third-party websites, services, or advertisements. We are not responsible for the content, privacy practices, or terms of use of any third-party services. Your interactions with third parties are solely between you and the third party. We encourage you to review the terms and policies of any third-party services you access.

The Game uses third-party services including:

  • Analytics services (Google Analytics, Firebase, Unity Analytics, Game Analytics)
  • Advertising networks (AdMob, Unity Ads, AppLovin, Vungle, AdColony)
  • Social login services (Google, Facebook, Twitter)
  • Backend services (PlayFab/Microsoft)

These third-party services are subject to their own terms and privacy policies.

12. Disclaimers and Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Game will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Game is free of viruses or other harmful components
  • Results from using the Game will be accurate or reliable

Your use of the Game is at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOLDEN FOX LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Game
  • Any conduct or content of any third party on the Game
  • Any content obtained from the Game
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or related to the Game shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Golden Fox LLC and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Game
  • Your User Content
  • Your violation of any rights of another party

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

If you have a dispute with us, you agree to first contact us at legal@goldenfox.games and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email.

15.2 Binding Arbitration

If the dispute cannot be resolved informally within thirty (30) days, you and Golden Fox LLC agree that any dispute arising out of or relating to these Terms or the Game shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver

You and Golden Fox LLC agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and Golden Fox LLC are each waiving the right to a trial by jury or to participate in a class action.

15.4 Exceptions

Notwithstanding the above, either party may bring a claim in court for injunctive or equitable relief regarding intellectual property rights or unauthorized access to the Game.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. However, applicable consumer protection laws in your jurisdiction may also apply.

For users in the European Union, nothing in these Terms affects your rights as a consumer under applicable EU consumer protection law.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms in the Game or on our website, and updating the "Last updated" date. Your continued use of the Game after such changes constitutes your acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Game.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Golden Fox LLC regarding the Game and supersede any prior agreements.
